1. General information

JLink places a high priority on information security and the careful handling of personal data. This Privacy Policy explains how we protect the confidentiality of personal data and respect your right to informational self-determination.

2. Confidentiality of personal data

We treat all collected data as confidential and in accordance with applicable data protection law. Our employees are bound to confidentiality and to the proper use of data-processing systems. Our technical safeguards reflect the current state of the art and are maintained continuously.

4. Purposes and legal bases of processing

Personal data collected through the JLink website is processed for contract performance, individual support and, where applicable, inclusion in our expert pool. Depending on the relationship, this may include:

• first name and surname;
• postal address;
• date and place of birth;
• marital status and nationality;
• email address and telephone or fax number;
• career information, including education, cover letters, photographs and certificates;
• IP address.

With the exception of the IP address, this information may be processed to enter into and perform a contract, for our own promotional communication and to meet statutory obligations towards public authorities. The legal bases are Article 6(1)(b), (c) and (f) GDPR. At least your name, postal address and email address may be required to establish your identity and to enter into a contract. Without the necessary data, a contractual relationship or communication may not be possible.

Where the website offers forms for personal or business enquiries or a newsletter, disclosure is voluntary. Without the information required by the respective form, we may be unable to process the enquiry or provide the requested communication. Where processing is based on consent, the legal basis is Article 6(1)(a) GDPR. This applies in particular to promotional communication with prospective clients.

5. Server log files

When you visit our website, connection data from the requesting device, the pages visited, date and duration of the visit, browser and operating-system identifiers and the referring website may be stored temporarily for system security. We do not collect your name, postal address, telephone number or email address through server logs unless you provide that information separately. Log files are processed on the basis of our legitimate interest in providing and securing the website under Article 6(1)(f) GDPR.

6. Contact forms

When you use a contact form, the information you provide is stored so that your message can be directed to the appropriate JLink contact. It is not used for unrelated purposes. Depending on the enquiry, processing is based on your consent under Article 6(1)(a) GDPR or on steps taken at your request before entering into a contract under Article 6(1)(b) GDPR.

7. Cookies and consent

Cookies are small text files stored by the browser. They can provide website functions and allow a browser to be recognised. Cookies that are not required to provide a service requested by the user are used only with consent in accordance with Section 25(1) TTDSG as stated in the German Privacy Policy; the related processing of personal data is based on Article 6(1)(a) GDPR.

Technically necessary cookies provide core website functions and cannot be disabled through the consent selection. Their storage is based on Section 25(2)(2) TTDSG as stated in the German Privacy Policy; related processing is based on our legitimate interest under Article 6(1)(f) GDPR. You can review or change your selection at any time through Privacy Preferences.

You can also restrict cookies in your browser settings. Restricting necessary cookies may affect website functions.

8. Recipients and international transfers

Within the limits permitted by law, personal data may be disclosed to recipients within the EU and to service providers outside the EEA, including Google Ireland Limited, Mailchimp/The Rocket Science Group LLC, Bullhorn Group Companies, JLink connecting experts GmbH, JLink temp experts GmbH, Neublck and zvoove.

Transfers to The Rocket Science Group LLC take place in the United States. The German Privacy Policy states that the provider is certified under the EU-US Data Privacy Framework and that transfers are therefore based on the relevant adequacy decision.

Bullhorn provides our recruitment CRM and applicant tracking system as a processor. Bullhorn Group Companies use the European Commission's Standard Contractual Clauses for transfers from the EEA to group companies outside the EEA. Bullhorn states that its relevant US entities also participate in the EU-US Data Privacy Framework. Further information is available in Bullhorn's Privacy Policy.

9. Inclusion as a business contact

With your consent under Article 6(1)(a) GDPR, we may include you in our business-contact database in order to remain in contact by email and telephone. This may cover enquiries about project support or permanent vacancies, the proactive presentation of candidate profiles and invitations to client events. We may process your name, address, email address, telephone and mobile number, professional-network profile, date of birth, position and any additional information you provide voluntarily.

Data may be shared with IT and newsletter service providers for operating the database and sending information, and with public bodies where required by law. It is retained until the purpose no longer applies, the data is no longer current or consent is withdrawn, subject to statutory retention obligations.

10. Information about third-party services

Bullhorn recruitment CRM and applicant tracking system

We use Bullhorn's cloud-based recruitment CRM and applicant tracking system to manage companies, business contacts, mandates, applications and candidates in connection with our recruitment services. Depending on the relationship, data listed in section 4 is processed for contract performance, pre-contractual steps, individual support, compliance with statutory obligations and our legitimate interest in providing and documenting recruitment services under Article 6(1)(b), (c) and (f) GDPR. Google Maps

We may embed Google Maps, provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, to show our office location. Data may include IP addresses and log data. The German Privacy Policy states that processing is based on our legitimate interest under Article 6(1)(f) GDPR. External content remains blocked until consent is given where consent is required.

zvoove

JLink uses the cloud software of zvoove Software Germany GmbH as an internal database for managing personnel resources. Data listed in section 4 is processed for contract performance, individual support and statutory obligations under Article 6(1)(b) and (c) GDPR. 11. Newsletter and client information

Newsletter registration requires a valid email address. We use a confirmation link to verify the subscription through a double opt-in process. Processing is based on Article 6(1)(a) GDPR. Mailchimp, operated by The Rocket Science Group LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA, is used to distribute newsletters and analyse their use.

Existing clients may receive information about related JLink services by email independently of a newsletter subscription where legally permitted. You may object at any time without costs other than the basic transmission charge, using the link in the email or by contacting kontakt@jlink.de.

12. Retention periods

We retain personal data only for as long as required by its purpose or by law. Contract and accounting data may be subject to retention periods of six or ten years. During a statutory retention period, processing is restricted accordingly. The period generally begins at the end of the calendar year in which an offer was made or a contract was performed.

13. Your rights

You may withdraw consent at any time with effect for the future. You also have the rights to access, rectification, erasure, restriction of processing, objection, data portability and to lodge a complaint with a supervisory authority, subject to the statutory requirements.

Right to object

You may object at any time to processing based on the performance of a task carried out in the public interest or on legitimate interests. Following an objection, we will no longer process the personal data unless we demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is required for the establishment, exercise or defence of legal claims.
